Hill fires are very common in this Colony in the
winter and they hamper very much the efforts of the Gov-
ernment towards afforestation. This Ordinance is an
attempt to cover ground which does not appear to be
covered sufficiently by the Malicious Damage Ordinance,
section s
on
1865, Ordinance No. 6 of 1865. The/in that Ordinance/which reliance has had to be placed hitherto are sections 16,
deal 19, 20, 21, 42, 43 and 44. None of these sections with the case of negligence, some of them apply only where the damage exceeds a definite amount, others
contain terms which are sometimes of doubtful application, and there seems to be no provision for the case of acts
damage which, though dangerous, do not cause any
in fact.
In my opinion this is an Ordinance to which His Excellency the Governor may properly assent in the name
of His Majesty and on His behalf.
